The bustling and beautiful Japan is open to married heterosexual couples seeking fertility treatment. Like in most East Asian countries, Japanese regulation doesn’t approve a single woman or a female couple to undergo IVF using donated sperm; and doesn’t approve a single man or male couple to undergo IVF using donated eggs and hire a surrogate mother for carrying a pregnancy. As of now, only a legally married heterosexual couple is eligible for starting fertility treatment. And here, it should be noted that single women are eligible for an egg-freezing cycle. Guidelines adopted by the Japan Society for Reproductive Medicine allowed unmarried women to do social egg freezing without medical cause from November 2013.

Japanese IVF clinics offer couples IUI, Sperm Donor IUI, IVF, Egg Donor IVF, Tandem IVF cycle, Sperm Donor IVF, Embryo Adoption, and FET. The new ART law stipulates that a woman who gives birth to a child created using a donated egg is the child’s mother, not the egg donor. It also says a husband who consents to his wife giving birth to the child created using donated sperm will be unable to deny that he is the child’s father.

Under the guidelines of the Japan Society of Obstetrics and Gynecology, couples having severe hereditary diseases are permitted to do preimplantation genetic testing to decrease and potentially eliminate the transmission of severe genetic diseases to the child. Preimplantation genetic testing for non–medical reasons is prohibited.

Japan has no regulations or laws regarding surrogacy. However, Japanese courts are likely to declare any surrogacy contract null and void because it is contrary to public policy. Moreover, any payment related to a surrogacy agreement will be considered a criminal offense. And the last thing to consider before initiating surrogacy in Japan: the surrogate mother will be recognized as the legal mother of the born child, and the intended parents will have to adopt the baby.
