On January 04, 2023, Israel’s Health Ministry amended the country’s New Surrogacy Law to provide equal access to any person in Israel. The New IVF Law officially comes into force on January 11, 2023.
The surrogacy process in Israel has always been strictly regulated. Until January 11, 2023, only infertile heterosexual couples — both of whom Israeli residents — or in some specific cases, —single women — Israeli residents — who had medical problems preventing them from conceiving and/or carrying a baby to term could opt for surrogacy in Israel. The latest news to add here is starting from January 11, 2023; the Israeli surrogacy law provides equal access to any person in Israel — single men, male couples, and transgender singles — they are eligible for Israeli surrogacy programs too. Before starting the surrogacy process, the designated state committee should approve the surrogacy agreement. The state committee must be convinced of the inability of the intended mother to carry a pregnancy to clarify the legitimate reasons for surrogacy. If the surrogacy agreement is improved, the single or couple is eligible for the surrogacy process.
