Multicultural Malaysia is not only a holiday destination. It is also an open country for fertility tourism. There are no specific laws or regulations on IVF in Malaysia. However, ‘Assisted Reproduction’ guidelines have been issued by the Ministry of Health and the Malaysian Medical Council — Malaysian Medical Council MMC Guideline 003/2006 (“MMC Guidelines”). The guidelines limit access to assisted reproduction techniques to married heterosexual couples only. Unmarried couples, singles, male couples, and female couples are not eligible for IUI and IVF programs. Malaysian fertility clinics offer ovulation induction, IUI, IVF, Donation Programs (Egg Donor IVF, Sperm Donor IVF), embryo vitrification and cryostorage, and frozen embryo transfer. Preimplantation genetic testing and sex selection are permitted but only to avoid the transmission of severe sex–linked disease. Pre–implantation diagnosis to create “designer babies” (those with specific physical or specific gender characteristics and not for the reason of avoiding a severe genetic disease) is prohibited. Surrogacy arrangements are prohibited as surrogacy is not acceptable to most of the major religions in the country.

Unmarried single women are permitted to vitrify their unfertilized oocytes for future cycles. In addition, unmarried men can opt for sperm freezing and storage services.
