For example, under Indonesian law, singles can freeze their unfertilized oocytes regardless of their marital status during the egg freezing cycle. But their cryopreserved eggs can only be fertilized by their husband’s sperm. Unlike most Asian countries, Indonesia allows gender selection in ART for the second child without mentioning medical or non–medical reasons. Egg donation, sperm donation, and the simultaneous donation of sperm and egg are strictly prohibited and criminalized. No one may sell or purchase sperm or oocytes, commercially or voluntarily donate sperm or eggs, or accept sperm or egg cells for completing the IUI or IVF cycle. Embryo donation is not allowed too.
Indonesian law does not allow surrogacy. It only allows IVF treatment, and any pregnancy involving the transfer of the woman’s embryo to the gestational carrier is legally contrary to Indonesian legislation, thus, cannot be done. Furthermore, the government has banned hiring a surrogate mother with the issuance of the Health Law, which provides criminal sanctions for those involved in surrogacy. Thus, all forms of surrogacy agreements conducted in Indonesia, by a married couple, or single Indonesian citizens are null and void because they conflict with existing laws and regulations.
